MRLP Firm Attorneys Author U.S. Supreme Court Amicus Brief on Behalf of the USFN, a National Industry Group

Jul 29, 2025

McCalla Raymer Leibert Pierce, LLP is proud to commend attorneys Rich Haber, Esq. and Brian Scibetta, Esq. for their outstanding work in authoring an amicus brief submitted to the United States Supreme Court on behalf of the USFN, a leading national organization serving the mortgage banking industry. The brief supports the petition for a writ of certiorari in U.S. Bank v. Fox, a case involving constitutional questions surrounding the retroactive application of the Foreclosure Abuse Prevention Act (FAPA) in New York.

The brief supplements the constitutional arguments raised in the petition by examining the wide body of case law that FAPA disrupts, the unusual legislative process through which it was enacted, and it’s broad-reaching negative effects.

The USFN publicly recognized Haber and Scibetta for their “exceptional work” on the brief, praising their insight, precision, and unwavering commitment to ensuring that the mortgage servicing industry’s perspective was clearly and powerfully conveyed to the Court. “We’re proud to stand alongside such outstanding advocates,” the USFN stated.

This collaboration reflects the firm’s continued commitment to supporting the legal integrity of the industry and engaging in precedent-shaping advocacy at the highest levels. The brief demonstrates not only deep legal scholarship but also a keen understanding of the broader policy implications that laws like FAPA create.

We congratulate Rich and Brian on this well-deserved recognition and thank them for their dedication to MRLP and the broader legal community.
